01Introduction
This Acceptable Use Policy (“AUP”) applies to your use of PristineSend (“Company”, “We”, “Our”, “Us”) services, products, and platforms (collectively, the “Service”). This policy is an addendum to our Terms of Service. In the event of any conflict, this AUP shall take precedence. By accessing or using the Service, you agree to comply with this policy.
02Prohibited Uses
You agree that you will not, and will not permit others to, use the Service for any purpose or in any manner that:
- Is illegal or violates any applicable laws, regulations, or third-party rights
- Could disable, overburden, damage, or impair the Service or interfere with any other party’s use of the Service
- Involves introducing any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful
- Attempts to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the servers on which the Service is stored, or any server, computer, or database connected to the Service
- Involves attacking the Service via a denial-of-service attack or a distributed denial-of-service attack
- Circumvents any authentication mechanisms or security features of the Service
- Attempts to reverse engineer, decompile, disassemble, or otherwise discover the source code or underlying technology of the Service
03Spam and Abuse
The Service is provided to facilitate legitimate email communication. You agree not to use the Service for spam, unsolicited bulk email, or any other abusive practices, including:
- Sending messages without proper consent from recipients
- Violating anti-spam laws including CAN-SPAM Act, GDPR, and other anti-spam regulations
- Harvesting or collecting email addresses without consent
- Impersonating another person or entity
- Phishing, social engineering, or attempting to deceive recipients
- Sending messages containing deceptive or misleading content
- Using the Service to send threats, harassment, or abusive messages
- Repeatedly sending messages to addresses that have unsubscribed or requested to not receive further communications
04Intellectual Property and Content
You agree not to:
- Send content that infringes on any third-party intellectual property rights, including copyrights, patents, trademarks, or trade secrets
- Send content that violates third-party privacy or publicity rights
- Send content that you do not have the right to use
- Distribute or facilitate the distribution of malware or dangerous code
- Send content that contains instructions for creating weapons, explosives, or other dangerous materials
05Harmful and Illegal Content
You agree not to use the Service to send, transmit, or facilitate the transmission of content that is:
- Obscene, indecent, or sexually explicit, particularly involving minors
- Related to child sexual abuse material or child exploitation
- Threatening, harassing, intimidating, or encouraging violence or illegal activity
- Discriminatory or hateful based on protected characteristics including race, ethnicity, religion, gender, gender identity, sexual orientation, disability, or national origin
- Promoting terrorism or violent extremism
- Related to human trafficking or modern slavery
- Facilitating illegal activities including fraud, money laundering, or drug trafficking
06Account Security
You agree to:
- Maintain the confidentiality and security of your account credentials
- Not share your account login information with others
- Not use another person’s account without authorization
- Immediately notify us of any unauthorized access to your account
- Use strong, unique passwords and enable two-factor authentication when available
07Data and Consent Requirements
You represent and warrant that you have obtained all necessary consents and permissions to send messages through the Service. Specifically:
- You have legitimate business relationship with all message recipients
- You have proper consent from recipients to send them messages in accordance with applicable laws
- You maintain accurate records of recipient consent
- You respect unsubscribe requests and honor opt-out preferences
- You do not purchase or use email lists from unauthorized third parties
- Your messages include accurate sender identification and contact information
- Your messages include a clear and functional unsubscribe mechanism
08Compliance Monitoring and Enforcement
PristineSend monitors the Service for compliance with this AUP. We may:
- Review message content to detect violations of this policy
- Investigate complaints and reports from recipients and third parties
- Monitor for spam, malware, and other security threats
- Take action to prevent abuse and protect the integrity of the Service
If we determine that you have violated this AUP, we may, at our sole discretion and without liability:
- Issue a warning or notice of violation
- Require remedial action within a specified timeframe
- Suspend your account temporarily
- Terminate your account and access to the Service
- Report your conduct to appropriate law enforcement or regulatory authorities
- Take legal action to recover damages or obtain injunctive relief
09Reporting Violations
If you discover that someone is violating this AUP or using the Service in violation of applicable laws, please report it to us immediately at abuse@pristinesend.com. Please provide detailed information about the violation, including relevant message headers, content, and the email addresses involved.
10Third-Party Content and Liability
While we monitor for violations, we cannot review all message content. We are not responsible for the content of messages sent through the Service. You assume full responsibility for:
- All content you send through the Service
- Ensuring your messages comply with applicable laws and this AUP
- Obtaining proper consent from all recipients
- Any legal claims, damages, or liabilities arising from your use of the Service
11Changes to This Policy
We may update this AUP at any time by posting the revised policy on this page. Your continued use of the Service following the posting of revised terms means that you accept and agree to the changes. It is your responsibility to review this policy periodically for updates.
